Visko Platform, Inc. (the “Company,” “Visko,” “we,” “us,” or “our”) is committed to safeguarding the privacy of our customers. This Privacy Policy describes how personal information, usage information, and User Content are collected, used, shared, stored, protected, and disclosed through visko.ai, its subdomains, associated applications, models, demonstrations, APIs, accounts, uploads, outputs, tools, features, and other services (collectively, the “Services”).
By accessing or using the Services, you acknowledge this Privacy Policy. If you do not accept it, discontinue your use of the Services. Your use is also governed by our Terms of Service.
We may update this policy from time to time. Continued use after an updated policy becomes effective means you acknowledge the revised policy, so please review it periodically.
1. Information We Collect
We collect information to provide and manage accounts and Services, process requests, communicate with users, improve our Services and AI models, maintain safety and security, and enforce our Terms of Service.
1.1 Technical and Usage Information
When you visit or use the Services, we may automatically collect:
- Device data: Internet Protocol address, device identifiers, operating system, browser type and settings, referring pages, mobile network, internet-service provider, connection information, language, and time zone.
- Usage data: Pages visited, features used, interactions, request and response times, session duration, and other information about how the Services are used.
- Log and troubleshooting information: Log files, performance data, errors, the time and feature involved in an error, application state, and related communications or content needed to investigate and resolve an issue.
- Cookies and similar technologies: Cookies, local storage, scripts, pixels, and similar tools used by Visko and our service providers to authenticate users, maintain sessions, remember preferences, measure and improve the Services, and protect against abuse. Browser controls may allow you to restrict these technologies, but doing so may prevent some features from working.
1.2 Content and AI Inputs
When you use the Services, we collect prompts, instructions, scripts, files, image or video uploads, audio, voice samples, and other inputs you provide, together with metadata contained in or associated with them (“User Content”). We may also collect AI-generated outputs, recordings you choose to save, edits, ratings, feedback, and other interactions with those outputs.
User Content may contain personal information about you or another person. You are responsible for ensuring you have the rights and legally required consents to provide that information.
1.3 Account and Contact Information
We may collect information you provide when creating or managing an account, joining a waitlist, requesting access, or contacting us, including:
- Email address.
- First and last name.
- Account identifiers and authentication information.
- Organization or professional information you choose to provide.
- Communications and support requests.
- Billing information processed by our payment provider.
1.4 Information from Other Sources
We may receive information from authentication providers, payment processors, infrastructure and AI providers, business partners, service vendors, and publicly available sources, and combine it with information collected through the Services where permitted by law.
2. How We Use Information
We may use personal information and User Content to:
- Provide and maintain the Services: Process requests, generate outputs, deliver model functionality, store user-selected recordings, and ensure the Services work correctly.
- Manage accounts and subscriptions: Register and authenticate users, administer access, manage plans, and provide customer support.
- Improve AI models: Use anonymized and aggregated User Content to train, fine-tune, evaluate, and improve our algorithms and AI models unless you have opted out as described in Section 6.
- Communicate: Send administrative messages, service notices, security alerts, responses to requests, and marketing communications where permitted.
- Process payments: Facilitate transactions and administer subscriptions through third-party payment processors.
- Personalize and analyze: Understand use of the Services, improve usability and performance, and personalize features.
- Safety screening: Apply automated safety screening and, where appropriate, authorized human review to prompts, uploads, outputs, accounts, and usage signals to detect, prevent, investigate, and respond to fraud, abuse, harmful content, and violations of our Terms of Service.
- Security: Protect users, Visko, service providers, and others against unlawful activity, unauthorized access, attacks, misuse, and threats to systems or networks.
- Debugging and dispute resolution: Identify and repair errors, respond to complaints, investigate disputes, preserve relevant evidence, and audit system performance.
- Enforcement and legal compliance: Enforce our Terms of Service, comply with law and valid legal process, protect rights and safety, and report potentially unlawful conduct when appropriate.
3. How We Share Information
We do not sell personal information. We may share information as follows:
- Affiliates: With subsidiaries and affiliates that support the Services, subject to this policy.
- AI providers: With providers such as Google and OpenAI when their systems are used to process prompts, uploaded material, context, or outputs and provide AI-powered features.
- Model infrastructure: With Reactor and related infrastructure providers that connect users to, operate, secure, or support Visko model sessions, uploads, queues, and recordings.
- Authentication: With Clerk and related identity providers to authenticate users, manage accounts, prevent fraud, and maintain secure sessions.
- Payment processing: With Stripe and other payment processors to process transactions, prevent payment fraud, and administer billing. Visko does not store full payment-card details submitted directly to a processor. Stripe’s handling of information is governed by its Privacy Policy.
- Service vendors: With cloud hosting, storage, analytics, communications, customer-support, security, moderation, and professional-service providers that perform services for us.
- Business transfers: With a buyer, successor, or other relevant party in connection with a merger, financing, reorganization, acquisition, bankruptcy, or sale of some or all of our business or assets.
- Legal and safety disclosures: When we believe disclosure is required by law or valid legal process, is needed to investigate or enforce violations, or is reasonably necessary to protect the rights, property, or safety of Visko, our users, service providers, or others.
- With your direction or consent: With a third party when you direct us to share information or otherwise consent.
Service providers may process information in the United States or other countries where they operate. Their own terms and privacy notices may also apply to services they independently provide.
4. Data Retention and Storage
Our servers, central databases, and service providers may be located in the United States. If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States and other countries whose data-protection laws may differ from those where you live.
We retain personal information and User Content only as long as reasonably necessary to provide the Services, fulfill the purposes described in this policy, maintain backups, secure the Services, resolve disputes, enforce agreements, and comply with legal obligations. Retention periods vary based on the type of information, the Service involved, user settings and requests, legal requirements, and operational needs.
5. Security and Content Responsibility
We use appropriate administrative, technical, and physical safeguards, including access controls, encryption where appropriate, monitoring, and network protections, to protect personal information. No transmission or storage system is completely secure, and we cannot guarantee absolute security.
You are responsible for prompts, instructions, files, images, videos, likenesses, voice samples, personal information, and other material you provide, as well as outputs you generate, publish, distribute, or otherwise use. Use the Services only in compliance with applicable law, our Terms of Service, and third-party rights.
We may monitor, screen, review, refuse, remove, preserve, or restrict access to content and may suspend or terminate access when we reasonably believe the Services are being used for unlawful, unauthorized, harmful, or prohibited purposes. Safety review may involve automated systems, authorized Visko personnel, and service providers acting on our behalf.
5.1 Likeness, Voice, and Performance Rights
If you provide a photo, video, voice recording, facial data, performance, or other material relating to an identifiable person, you represent that you have provided all required notices and obtained all rights, permissions, releases, and consents necessary for Visko and our service providers to process the material. Your use must not violate publicity, privacy, copyright, contractual, employment, union, guild, confidentiality, or other proprietary rights.
6. Your Rights and Choices
Depending on where you live, you may have rights to access, correct, delete, restrict, object to, or obtain a portable copy of personal information, withdraw consent, or appeal a decision concerning a privacy request. These rights may be limited by applicable law, and we may need to verify your identity before acting on a request.
To submit a privacy request, contact [email protected]. You may also designate an authorized agent where applicable law permits. We will not discriminate against you for exercising a privacy right.
6.1 AI Training Opt-Out
You may opt out of having future User Content used to train Visko AI models by contacting [email protected]. The opt-out does not affect User Content already incorporated into model training before we process your request, and historical model improvements will remain in effect.
6.2 Marketing Communications
You may opt out of marketing emails by using the unsubscribe link in an email or contacting us. You may still receive non-marketing messages about your account, transactions, security, or material changes to the Services.
6.3 European Privacy Rights
If you are in the European Economic Area, United Kingdom, or Switzerland, applicable law may provide rights including access, rectification, erasure, restriction, objection, portability, and withdrawal of consent. You may also have the right to complain to your local data-protection authority.
Where required, our bases for processing include performance of a contract, compliance with legal obligations, your consent, and our legitimate interests in operating, improving, securing, and enforcing the Services, balanced against your rights.
6.4 California Privacy Rights
California residents may have rights to request disclosure of categories and specific pieces of personal information collected; request correction or deletion; learn the categories of sources, purposes, and recipients; opt out of certain sales or sharing; limit certain uses of sensitive personal information; and receive equal service and pricing when exercising privacy rights.
Visko does not sell personal information. If our practices change in a way that triggers an opt-out right under applicable law, we will provide the required mechanism and update this policy.
7. Children's Privacy
The Services are not intended for anyone under 18, and we do not knowingly collect personal information from anyone under 18. If you are a parent or guardian and believe a child has provided personal information, contact [email protected] so we can investigate and take appropriate action.
8. Links to Other Services
The Services may contain links to third-party websites or services. We do not control and are not responsible for their content, privacy policies, or practices. Review the privacy policy of every third-party service you use.
9. Changes to This Privacy Policy
We may update this Privacy Policy periodically. We will post the revised policy on this page, update the Last Updated and Effective Date fields, and provide any additional notice required by law. Review this page periodically for changes.
